1. DEFINITIONS

For the purpose of this document and all its applications, the following words/phrases will have the meanings outlined as follows:

i) Site Sections refers to:

a) The homepage of the analytics.ga website

b) The site pages at analytics.ga, which are standalone pages, as well as those which are a part of it’s ‘blog updates’ section (hereafter termed “Blog”), and their comment storage, retrieval and display systems

c) The analytics.ga/testing-lab/ section of the site, which provides an environment for simulation of analytics implementations and also doubles as an area for posting test details (if needed) and/or their results (if applicable)

d) The client-specific pages on analytics.ga, which are password protected and meant for keeping clients up-to-date on the progress of their projects

ii) Attributes of Analytics.GA include the following (and also function as Attributes of the website “analytics.ga”):

a) Site Sections of the analytics.ga website as outlined above

b) Online or offline documents associated with Analytics.GA, mentioning or excluding its staff members

c) Proposals, project samples, agreements and quotations associated with Analytics.GA, mentioning or excluding its staff members

d) Advertisements associated with Analytics.GA, mentioning or excluding its staff members

2. APPLICATION

These Terms of Use apply to the visitors, prospects, customers and clients of Analytics.GA, and also apply to anyone who attempts to visit the website analytics.ga and/or use its Attributes, for any purpose whatsoever – either directly by typing in a URL, or by clicking on an affiliate link, referral link, redirecting-link, social media link/post, link in an online advertisement, visiting any advertised URL (online or offline), visiting a shortened-link leading to this website or any of its Attributes, visiting a search engine result, visiting any other mention of Analytics.GA or its website in any form.

Your use of this website, or its Attributes, deems true your acceptance of the Terms of Use laid out in this document.

3. GENERAL TERMS OF USE

Anyone who uses this website and/or any of its Attributes AGREES TO THESE GENERAL TERMS OF USE:

a) You accept and agree to abide by all the terms, conditions and disclaimers laid out in this document, as well as in the Privacy Policy, Terms of Service, Disclaimers and Legal Matters documents on this site. You also agree to be bound by all terms mentioned in other documents associated with any business you conduct (or propose to conduct) with Analytics.GA, terms stated in conversations with staff member(s) from Analytics.GA and terms mentioned in any drafted agreement(s) made in your case.

b) You understand and fully accept that Analytics.GA and all of its associates and affiliates do not make any claims about assured benefit to you and/or your business/venture/self-employment-operation by doing business with Analytics.GA.

c) You understand and fully accept that there is no guarantee that you will earn any money using the procedures, techniques and ideas mentioned on the analytics.ga website, on any of its Attributes, and by using the advice/recommendations otherwise made available to you by Analytics.GA. Examples, estimates and projections in these materials are not to be interpreted as a promise or guarantee of earnings.

d) You understand and fully accept that earning potential is entirely dependent on the person/company using the procedures, ideas and techniques, their industry and market conditions at the time of such application, before application as well as after application.

e) You understand and fully accept that your level of success in attaining the results talked of/written about in any materials on this site and in its Attributes depends on the time you devote to the application of the procedures, ideas and techniques in those materials, your finances, knowledge and various skills. Since these factors differ according to individuals and businesses, Analytics.GA cannot guarantee your success or income level and cannot be held responsible for actions taken by you and your staff.

e) You understand and fully accept that Analytics.GA and any of its associates and affiliates do not purport their services to you as get-rich schemes.

f) You understand and fully accept that any claims made of actual earnings or examples of actual earnings can only be verified for an existing/former client of Analytics.GA – on request – and whether to fulfill such requests or not is a decision that will be subject to the discretion of the Director/Chief Analyst at Analytics.GA. The person making this decision is granted authority to deny the request without citing any reason and this is deemed to be understood and accepted by you, if you continue to use this site or ask for any such verification.

g) You understand and fully accept that Analytics.GA disclaims any warranties (express or implied), merchantability, or fitness for any particular purpose. Analytics.GA and its staff shall in no event be held liable to any party for any direct, indirect, punitive, special, incidental or other consequential damages arising directly or indirectly from any use of its material, which is provided “as is”, and without warranties.

As always, the advice of a competent legal, tax, accounting or other professional should be sought. For your information regarding this website’s domain, the webmaster at Analytics.GA is the registered user of the domain name: analytics.ga, of which the licensee is the ICANN accreditated registrar FREENOM (or one of its subsidiaries).

Intellectual Property Notice

All creative material and analytics related information on this site, or otherwise pertaining to Analytics.GA, is the intellectual property of Analytics.GA, unless otherwise credited to someone else or legitimately claimable by someone else. This intellectual property is protected under appropriately applicable copyright laws and all other applicable regional (by country), federal, state and local laws, with ALL rights reserved. No part of this website or any of its Attributes may be copied, changed in any format, stored, sold, or used in any way – other than what is outlined within Analytics.GA – under any circumstances, without the express permission of the Director/Chief Analyst at Analytics.GA.

4. TERMS REGARDING EXTERNAL LINKS

Analytics.GA links to other, external web sites that provide data, content or software determined at its discretion to contain the most useful information/leverage for its visitors, prospects, customers and clients. While many sites provide very useful information, software and services, Analytics.GA only links to those sites which provide what is viewed useful by its staff at the time of linking.

Analytics.GA does not warrant the performance, effectiveness or applicability of any sites listed on or linked to by it, and listed on or linked to by its attributes. The sites and webpages are linked to because they were found useful, but all links are for information purposes only (unless otherwise stated) – their content, accuracy, any implied or explicit detail and intended purpose of use is not the responsibility of Analytics.GA and is not warranted by it.

These links may be changed at any time as more useful sites come to the staff’s attention. Neither a reader/user of content/software/external-services, nor the entity to whom a link was placed may question or challenge such a change. The sole purpose of any external link is to enrich this site for customers. All requests for inclusion of a link on this site are first and primarily evaluated with the needs of Analytics.GA’s customers in mind. Generally, external web sites do not meet the purposes of Analytics.GA if they contain, suggest, or infer any of the following:

1. Advocacy of or opposition to any politically, environmentally, or socially controversial subjects, issues, or candidates.
2. Disparaging or promoting any person or class of persons.
3. External content not suitable for readers or viewers of all ages, or links to or other promotion of businesses whose products or services are not suitable for persons of all ages.
4. Promoting or inciting illegal, violent, or socially undesirable conduct.
5. Promotion or availability of alcohol or tobacco products.
6. Promotion or availability of illegal drugs.
7. Promotion or availability of adult or sexually oriented entertainment or materials.
8. Promotion, opposition, or availability of weapons.
9. Promotion, opposition, or availability of gambling.
10. Claims of efficacy, suitability, desirability, or other non-objective statements about businesses, products, or services.
11. Content that infringes on any trademark, copyright, or patent rights of another.
12. Claims or representations in violation of advertising or consumer protection laws.
13. Content that a reasonable citizen may not consider to maintain the dignity and decorum appropriate for government.

This list is a non-exhaustive list. The Terms Regarding External Links apply only to web sites and entities outside Analytics.GA.

The webmaster shall establish procedures to monitor the implementation and continuing oversight of this policy. These procedures shall include a process for review of all new requests for external content links (from a web page on Analytics.GA to another page) to ensure compliance with these terms prior to granting the request.

Each request for such a link shall be evaluated using the following guidelines:

a) Is the content, software or service relevant?

b) Does the site provide information or services which are not already available or linked to on Analytics.GA? If not, is the quality of the site comparable to or better than what is already provided?

Analytics.GA reserves the right to, at its sole discretion and without explanation, withdraw at any time any external content or outbound-link for reason(s) it finds valid. Such reason(s) and/or their basis for validity may not be made public in each and every instance.

5. TERMS REGARDING USER ACTIVITY

The following terms apply to visitors of this site as well as to those who mention it somewhere either socially, casually or with serious intent. These apply to those who do business with Analytics.GA, and also to those who have had any exposure to Analytics.GA but aren’t customers or clients. These apply to all of Analytics.GA’s affiliates, associates and staff. These apply to anyone who tries to contact Analytics.GA or its staff in any way. The general term being used, from here on, to refer to all these categories of people is: “user

Here are the Terms Regarding User Activity:

a) A user may not bad-mouth Analytics.GA, its materials, strategies, advertising, staff, associates and affiliates in any way whatsoever, for any reason whatsoever. Constructive criticism has its place where freedom of speech is allowed, but bad-mouthing an entity can easily damage its reputation and hurt its business interests.

b) A user may not pretend or pose to be a representative of/from Analytics.GA, for any purpose, and especially not for the purpose of spreading wrong information about the staff or business practices of Analytics.GA. If you wish to send out mails for generating leads, or wish to do any commercial activity in collaboration with Analytics.GA, you must first become an associate or affiliate of Analytics.GA, by signing a legal agreement that clearly defines what you may and may not do to generate such business and what compensation you can expect in return. c) Users may not spread any information about Analytics.GA that they are unsure about, even if it is positive. Affiliates and Associates marketing Analytics.GA’s services (or using its brand-name to generate business of any kind) are not permitted to make claims that have no verifiable basis and/or source within Analytics.GA.

d) A user may not raise arguments or unethical/rowdy discussions with other users of this website or with a site administrator. You are allowed your opinions on any matter. Your opinions are subject to your own volition. But in no circumstances is a user to force their volition on others. Do not tempt/deceive someone into voicing your volition, or opinion(s) that they would not hold in their well-informed and fair judgement. In other words, no user is allowed to influence others to achieve any kind of motive, or to use malicious means for furthering an agenda. Also, users who play two or more people/parties against each other will be dealt with seriously, irrespective of whether or not they gained anything by indulging in such activity.

e) Users are required not to post on this website, or on its attributes, anything that they do not wish to make public. If something goes viral, Analytics.GA can not be held responsible for the problem, as it will lose control over the reach of such information and media, the moment it starts spreading.

f) A user’s conduct, both on and off the site (with regard to Analytics.GA) must be clear of all of the following offenses:

1. Advocacy of or opposition to any politically, environmentally, or socially controversial subjects, issues, or candidates.

3. External content not suitable for readers or viewers of all ages, or links to or other promotion of businesses whose products or services are not suitable for persons of all ages.

12. Claims or representations in violation of advertising or consumer protection laws.
13. Content that a reasonable citizen may not consider to maintain the dignity and decorum appropriate for government.

6. ANTI-SPAM RULES

Analytics.GA prohibits the use of any method on its behalf (or pretending to be on its behalf) associated with the transmission, distribution or delivery of any unsolicited bulk or unsolicited commercial e-mail (“Spam”). You may not deliver Spam or cause Spam to be delivered to any of Analytics.GA’s users.

In addition, e-mail sent, or caused to be sent, to Analytics.GA or through Analytics.GA’s services may not:

1. Use or contain invalid or forged headers;
2. Use or contain invalid or non-existent domain names;
3. Employ any technique to otherwise misrepresent, hide or obscure any information in identifying the point of origin or the transmission path;
4. Use other means of deceptive addressing;
5. Use a third party’s internet domain name, or be relayed from or through a third party’s equipment, without permission of the third party;
6. Contain false or misleading information in the subject line or otherwise contain false or misleading content; or
7. Otherwise violate the applicable rules and terms applying to the services.

Analytics.GA does not permit or authorize others to use its services to collect, compile or obtain any information about Analytics.GA’s customers or clients, including but not limited to user e-mail addresses, which are Analytics.GA’s confidential and proprietary information. Use of the services is also subject to the applicable Privacy Policy and Terms of Service.

Analytics.GA does not permit or authorize any attempt to use its services in a manner that could damage, disable, overburden or impair any aspect of any of the services, or that could interfere with any other party’s use and enjoyment of any service.

If Analytics.GA believes that unauthorized or improper use is being made of any service, it may, without notice, take such action as it, in its sole discretion, deems appropriate, including blocking messages from a particular internet domain, mail server or IP address. Analytics.GA may immediately terminate any account or agreement on any service which it determines, in its sole discretion, is transmitting anything in violation of this “Terms of Use” policy or is otherwise connected with any entity that violates this policy.

Nothing in this policy is intended to grant any right to transmit or send e-mail to, or through, the services.

Unauthorized use of the services in connection with the transmission of unsolicited e-mail, including the transmission of e-mail in violation of this policy, may result in civil, criminal, or administrative penalties against the sender and those assisting the sender.

And importantly, failure to enforce this policy in every instance does not amount to a waiver of Analytics.GA’s rights.

7. REVISIONS AND UPDATES TO TERMS OF USE

Due to the nature of these terms and the Internet, Analytics.GA will not be able to contact individuals who have visited the website individually in order to notify them of changes to the terms.  However, the most recent version of the Terms of Use will be made continuously available, barring unforeseen technical issues, at the Terms of Use webpage on the analytics.ga website, and the most recent revision date will be posted on each such instance of the Terms of Use.
